By booking Caroline Bay Photography (CBP) for your portrait session, you agree to be bound by the Terms & Conditions set out below.
Payment of the session fee is due at the time of booking. Payment for all additional products ordered must be made at the time of ordering.
Should the Client need to postpone, then the session fee will be applied to the new booking. If the client cancels and does not rebook, then the session fee will be retained by CBP. If CBP has to cancel the session for reasons beyond their control (death, injury, sickness, etc.), their liability shall be limited to a full refund of all monies paid.
CBP shall be granted creative and artistic licence in relation to the voice of location and poses used. CBP's judgement on photographic style and the number of photographs taken shall be deemed correct. Some photographs may not be possible due to changes of the weather and the availability and willingness of subjects. CBP will do their best to honour requested photographs but does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.
In the event of a minor being photographed (under 18 years of age), then a parent or guardian must be present at all times during the photo session. The Client must not take any photographs or videos without first obtaining permission from CBP.
CBP aims to have the Client's viewing session / online gallery available within one week of the photo session; however, during busy periods this timeframe may be extended. Orders must be made in person at the viewing session or within one week of the online gallery being posted. CBP reserves the right to charge a late payment fee if the Client does not place an order within these timeframes. All images will be archived after a period of 3 months and a retrieval fee of £50 charged.
CBP aims to have images edited within 14 days of the order being placed; however, during busy periods this timeframe may be extended. Bespoke products may take longer depending on supplier lead times. Any delay in payment will affect the delivery period.
The Client grants CBP the right to use a Client's images for advertising and promotion in various media (including CBP's own website), entry into photographic contests or art exhibitions, editorial use, for the creation of samples or for display within or on the outside of any studio used by CBP. No names or any other identifying information will be disclosed when using images for these purposes.
If CBP wishes to use any of the Client's images for commercial purposes where payment is sought or received, such as the sale of images to photographic libraries, CBP will not do so without first obtaining the written permission of the Client.
CBP will own the copyright in all images created. RAW images will remain the property of CBP and can not be transferred to the Client or purchased. The Client is obtaining images for personal use only. They may not be published or sold, without the express written permission of CBP.
The Client may not alter, add to or manipulate an image by any means. Permission to reproduce (e.g. scanning, copying, printing) an image is granted to the Client by CBP only when digital images are purchased.
In the unlikely event that the Client is unhappy with any of the products from CBP, every issue will be made to rectify the issue. Incorrectly supplied items and items of poor quality can be returned and will be replaced on return of the item. The Client must report the issue within 48 hours of receipt. Returns will not be considered for incorrectly ordered items or items ordered in error. No return, exchange or refund is available on any item once the order has been placed. For digital files no refunds are available once they have been received by the Client.
In the unlikely event of total photographic failure, injury or sickness beyond CBP's control, their liability shall be limited to a full refund of all monies paid. This limitation of liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of CBP. In the event that CBP fails to perform for any other reason, CBP shall not be liable for any amount in excess of the retail value of the Client's order.
The purchase of digital files releases CBP from any liability due to future loss or damage of the images and from any obligation to maintain copies of any digital file, image or photograph. It is the responsibility of the Client to ensure adequate back up of digital files.
